1. Definitions
OpenGPSR – technical project providing a public view of data and tools for browsing it.
User – any natural person, legal entity, or automated system using the service, API, or downloading data.
Data – publicly available information about economic operators and contact points, along with metadata (sources, versions, verification status).
API – programming interface intended primarily for reading data.
2. Disclaimer
- No Legal Advice: OpenGPSR is a technical tool. Information does not constitute legal advice or interpretation of regulations. Compliance assessment belongs to the User.
- No Guarantee of Accuracy and Completeness: Data may be incomplete, outdated, or incorrect. Verification statuses are for informational purposes only.
- No Liability for Damages: OpenGPSR and contributors are not liable for damages resulting from the use or inability to use the service or data, to the fullest extent permitted by law.
3. User Obligations
- Verification: The User undertakes to independently verify data before using it in business processes, documentation, or publication (due diligence).
- License and Attribution: When further sharing public data, the User should preserve source information (attribution) and — if possible — the record's verification status.
- No Data Poisoning: Deliberately submitting false, misleading, or sabotage-intended data (data poisoning) is prohibited.
- Reporting Corrections: We encourage reporting errors and outdated information via the form or project channels, along with a verifiable source.
4. Infrastructure Protection (Scraping and Abuse)
To ensure service availability for everyone, we apply protective mechanisms (e.g., rate limiting). The User undertakes to:
- FORBIDDEN Aggressive Querying: Actions burdening the infrastructure (e.g., mass downloading of HTML pages or multiple queries exceeding technical limits) are prohibited. Use the API or available data dumps if needed.
- FORBIDDEN Bypassing Security: Bypassing traffic limiting mechanisms (rate-limiting), CAPTCHA, or other security measures is prohibited.
- Recommendation: For cyclic integrations, we recommend using dumps or incremental mechanisms instead of constantly querying individual records.
5. OpenGPSR Rights
The project maintainers reserve the right to:
- Moderation and Security: limiting functionality, blocking abuse, hiding records from public view, or marking them as disputed/outdated, particularly in cases of legal risk, Source Policy violation, or suspected abuse.
- Technical Changes: changing the API and data structure. Backward compatibility may not be preserved in development versions (v0.x). Changes in stable versions will be communicated where possible.
- Availability: temporary or permanent shutdown of the service without SLA guarantee.
6. Data License and Legal Compliance
Public data is made available under the CC BY 4.0 license, unless stated otherwise. The license regulates content usage conditions but does not waive obligations arising from legal regulations (including GDPR), if data in a specific context could constitute personal data.
The User downloading data and processing it in their own system is independently responsible for the legal basis, scope, retention, and method of data sharing in their use case.
